Be sure to include:
� all living children legally adopted by you; and,
� all living step-children who are unmarried and under the age of 21 on the date of your electronic entry, even if you are no longer legally married to the child’s parent, and even if the child is not currently reside with you and / or will not immigrate with you.
A child who is already a U.S. citizen or LPR is not eligible for a Diversity Visa; you will not be penalized for such or omitting such family members from your entry.
Failure to list all children who are eligible will be the result of disqualification of the principal applicant and refusal of all visa applications in the case at the time of the visa. See the Frequently Asked Questions for more information about family members.
Children: You must list your children, your step-children (even if you are now divorced from that child’s parent) , your spouse ‘s children,. List all children under 21 years of age at the time of your electronic entry, even if they no longer reside with you or you do not intend for them to immigrate under the DV program. You are not required to list children who are already U.S. citizens or Lawful Permanent Residents, although you will not be penalized if you do.
Parents and siblings of the entrant are ineligible to receive DV visas as dependents, and should not be included in your entry.
If you list family members on your entry, they are not required to apply for a visa or to immigrate or travel with you. However, if you fail to include an eligible subject, you will be disqualified at the time of your visa. . This only applies to those who were at home. Your spouse, if eligible to enter, may still be able to submit a separate entry.
If the couple lives in an unregistered marriage and has common children, but the father is not indicated in the child’s birth certificate (or any other person is indicated by the father) and the actual paternity is not documented, the man may not indicate such a child in his application.
